ARTICLE 1: DEFINITIONS

In these general conditions, the following definitions shall apply:
The Copie-Sjop: A trade name Kopie 5 B.V. located at Westvest 47(-53), registered with the Chamber of Commerce under number 24266834, and responsible for the sale of products and services through the website www.copie-sjop.nl.

  1. Client:
    The term “client” refers to any natural or legal person who has commissioned the Copie-Sjop to provide products or services.
  1. Information carriers:
    “Information carriers” include optical disks and any other means intended for recording, editing, transmitting, reproducing, or disclosing text, images, or other data, in the broadest sense.
  1. These general conditions apply to all agreements concluded between the client and the Copie-Sjop relating to the formation, content and fulfillment of the agreement.
  2. Any general (purchase) conditions of the client are only applicable if expressly agreed in writing and to the exclusion of these general conditions of the Copie-Sjop.
  1. The issuing of a quotation, budget, pre-calculation or similar communication does not oblige the Copy-Shop to enter into an agreement, unless otherwise agreed.
  2. Copie-Sjop offers are without obligation and can only be accepted without deviations. An offer is deemed rejected if it is not accepted within one month.
  1. The client may cancel an agreement before the Copie-Sjop has begun performance, provided that the client compensates the damage caused thereby, including losses suffered, lost profits and costs incurred.
  2. Cancellation of agreements for production of periodic publications is not possible.
  3. The “distance buying” law offers clients a cooling-off period, but it does not apply to custom-made products from the Copie-Sjop.
  1. All prices quoted include sales tax (V.A.T.) and other government imposed charges.
  2. The quoted price applies only to performance in accordance with the agreed specifications.
  3. In the case of composite offers, there is no obligation to deliver part of the performance at a proportional price, unless otherwise agreed.
  1. The Copie-Sjop may increase the agreed price under certain circumstances, such as increases in costs for materials, wages, or government taxes.
  2. Extra laborious text, unclear copy, or other supplies requiring more work than reasonably expected may result in an increase in the agreed price.
  3. The Copie-Sjop may increase or decrease the price when changing the originally agreed specifications, provided it is within reasonable limits.
  1. Payment must be made within 14 days of the invoice date, unless otherwise agreed.
  2. At the Copie-Sjop’s request, the client must provide security for payments.
  3. If the client has chosen “pay on pickup” and has not picked up and paid for the order after 14 days, the Copie-Sjop will send a reminder to the client to make payment. If this reminder is not heeded, the Copie-Sjop reserves the right to send an online payment request (invoice) to the client.
  1. The client shall cooperate fully in the delivery of the goods to be delivered.
  2. Delivery is made under reservation of ownership until full payment has been made.
  1. Stated deadlines for delivery are indicative and are never to be considered deadlines, unless expressly agreed otherwise in writing.
  2. Delay in delivery does not entitle the client to compensation or dissolution of the agreement, unless the delay is due to intent or gross negligence on the part of the Copie-Sjop.
  1. Upon delivery of the goods, the client shall examine whether the delivery complies with the agreement.
  2. Visible defects or shortages must be reported in writing to the Copie-Sjop within 14 days of delivery.
  1. Returns must be reported in writing to the Copie-Sjop within 14 days after receipt of the delivered goods, giving reasons.
  2. Return shipments will be accepted only if the Copie-Sjop has given prior written consent.
  1. Deviations in quality, quantity, width, color, finish, format, etc. that fall within reasonable limits shall not entitle the customer to rejection or compensation.
  2. As for the items to be delivered by the Copie-Sjop, a tolerance of 10% in more or less quantity delivered applies, unless otherwise agreed.
  1. Agreements for periodic releases are for an indefinite period, unless otherwise expressly agreed in writing.
  2. Duration agreements can be terminated subject to a notice period of at least three months, unless otherwise agreed upon.
  3. Termination must be in writing.
  1. The client guarantees the Copie-Sjop that no intellectual property rights of third parties are infringed by the performance of the agreement.
  2. All rights of intellectual property relating to advice, designs, images, drawings, models, software, etc. provided by the Copie-Sjop shall be held exclusively by the Copie-Sjop or its licensors, unless otherwise agreed in writing.
  1. The Copy-Shop respects the privacy of its users and processes personal data in accordance with applicable laws and regulations, including the General Data Protection Regulation (AVG).
  2. Personal information provided by users when registering, placing orders or otherwise using the website will be kept confidential and used only for the purposes for which it was provided.
  3. The Copie-Shop may use personal information to keep users informed of relevant information, offers or updates regarding the Copie-Shop’s services, unless users explicitly indicate that they do not want this.
  4. Users have the right to access, correct or delete their personal data at any time. To do so, they can contact the Copie-Sjop using the contact information provided on the website.

  1. If the client provides materials or data for the manufacture of products by the Copie-Sjop, the client guarantees that he is entitled to use them and indemnifies the Copie-Sjop for any claims of third parties.
  1. The Copie-Sjop strives for complete satisfaction of its customers. However, should a customer not be satisfied with the products or services, we offer a complaint mechanism to resolve the issue as quickly and efficiently as possible.
  2. Customers may file a complaint by contacting our customer service department using the contact information available on the website. Complaints can relate to a variety of issues, such as product quality, service or communication.
  3. The Copie-Sjop will take any complaint seriously and strive for a quick and appropriate solution. In principle, complaints are handled within 5 working days. If more time is needed for investigation or handling, the customer will be informed.
  4. Complaints must be made within a period of 14 days from the date of receipt. The Copie-Sjop will make every effort to handle complaints to the best of its ability and strive for a solution that is acceptable to both the customer and the Copie-Sjop. We are committed to improving our services based on the feedback we receive.
  5. If the online store is affiliated with WebwinkelKeur and complaints cannot be resolved by mutual agreement, the consumer should contact WebwinkelKeur(www.webwinkelkeur.nl), which will mediate free of charge.
